What Rights Do You Have Under the Implied Consent Law?

Minnesota’s implied consent law states that a person who makes the choice to drive a motor vehicle consents to DWI tests that determine whether their blood, breath, or urine has the presence of alcohol. The implied consent law doesn’t automatically mean that you need to agree to blood alcohol testing at the time of the arrest; you are allowed to refuse to take the roadside test. However, refusing to take a breath test at the police station will result in additional charges being added to your case.
